These Terms of Service (“Terms”) govern your access to and use of mylovely.ai and any related websites, apps, and services (collectively, the “Services”). The Services enable chats and media generation with AI characters (“AI Companions”) and may produce text, images, audio, and video (“AI Output”).
By accessing or using the Services, you agree to these Terms and to all policies referenced here (collectively, the “Policies”). If you do not agree, do not use the Services.
Service Provider Identity (Spain / LSSI): The Services are operated by PROMPTREPUBLIC S.L., a Spanish limited liability company registered in Spain with company number B21965884 and registered office at Av Juan Antonio Samaranch 0051, Madrid, 28055, Spain (“we”, “us”, “our”). Contact: support@mylovely.ai.
The Services are for adults only (18+) or the age of majority where you live, whichever is higher. You must not use the Services if you are under the applicable age. We may require age verification (including third‑party checks) and may deny or terminate access if verification fails or is refused. Attempting to depict, solicit, or suggest sexualized content involving minors is strictly prohibited and will be reported to law enforcement.
Some features require an account with an email and password or alternative login. You must provide accurate information, keep it updated, and keep your credentials confidential. You are responsible for all activity under your account. Accounts are personal, non‑transferable, and may not be sold, shared, or rented. We may suspend or terminate any account for suspected violations of these Terms, our Policies, or applicable law.
Parts of the Services are paid (e.g., subscriptions, credits/tokens). Prices and plan details are shown at purchase.
We accept bank cards (processed by PCI‑compliant processors) and cryptocurrency (via supported gateways). You authorize us and our processors to charge your chosen method.
Subscriptions renew automatically for the same term unless you cancel in the account settings before the renewal date. After cancellation, access remains until the current term ends; premium features then stop, and unused credits may expire.
Prices may include or exclude applicable taxes. For EU/EEA consumers, VAT is applied as required. For crypto payments, tax/VAT calculations use the fiat equivalent at the time of the transaction. You are responsible for any additional taxes owed under your local laws.
Crypto transactions can be irreversible and subject to price volatility, network fees, and confirmations. We generally cannot adjust for rate changes or network issues outside our control.
If you initiate a chargeback, we may immediately suspend or cancel your subscription and access.
For digital services, you may have a 14‑day withdrawal right. However, when you purchase a subscription or credits, you expressly request immediate performance and acknowledge losing the right of withdrawal once access to premium features or credits begins. We will obtain this acknowledgment at checkout.
If you are an EU consumer who has not started using any premium features/credits and withdraws within 14 days, we will refund the subscription fee (less any unrecoverable processor or network costs).
Outside the above, refunds are not guaranteed. We may, at our discretion, consider refunds requested within 24 hours of purchase and where usage is de minimis (e.g., minimal messages/credits used).
Crypto payments are generally non‑refundable except where legally required or where we choose to refund at the fiat‑equivalent value at the time of payment, less irreversible fees.
Upon refund or chargeback, premium access and any remaining credits are revoked immediately.
The Services (including software, models, systems, interfaces, site design, and content we provide) are owned by us and our licensors and are protected by law. We grant you a limited, revocable, non‑exclusive, non‑transferable license to use the Services for your personal, non‑commercial use, subject to these Terms.
As between you and us, you retain rights to your prompts and inputs (“Input”) and—subject to third‑party rights—you own your AI Output to the extent permitted by law.
You grant us a worldwide, non‑exclusive, royalty‑free, transferable, sublicensable license to use Input and AI Output to (a) provide the Services to you; (b) ensure trust & safety (including moderation, abuse detection, and legal compliance); (c) maintain and improve the Services and underlying AI (including evaluation, debugging, and training), as described in our Privacy Policy. Where required by law, you can opt out of improvement uses.
You must not submit Input or generate/redistribute AI Output that infringes others' rights (e.g., copyright, trademarks, publicity/privacy). You are responsible for securing any necessary permissions.

Zero Tolerance Policy: Any attempt to generate, request, or create content involving the prohibited topics listed above will result in immediate account termination and may be reported to law enforcement authorities. We maintain strict monitoring and automated detection systems to prevent such content generation.
The Services are 18+ and may include NSFW/erotic AI Output for adult users.
All conversations and AI Output are fictional. AI Companions are not real persons.
18 U.S.C. §2257 Exemption: The Services do not include visual depictions of actual sexually explicit conduct of real persons; content is AI‑generated and fictional. Accordingly, the Services are exempt from 18 U.S.C. §2257 record‑keeping requirements.
We maintain a zero‑tolerance policy for CSAM and will report suspected violations to competent authorities.
We use automated and manual moderation to enforce these Terms. We may review, restrict, remove, or refuse content; introduce friction; suspend features; or suspend/terminate accounts at our discretion.
Report content or issues: support@mylovely.ai (include URLs, screenshots, timestamps, and a clear description). We will process notices consistent with the EU Digital Services Act (DSA) and applicable law and provide reasoned decisions where required.
If you believe content infringes your rights, email support@mylovely.ai with: (i) your contact info; (ii) description of the work claimed infringed; (iii) the content's location/URL; (iv) a statement of good‑faith belief; (v) a statement of accuracy and authority; and (vi) your signature (digital acceptable). We may share your notice with the user and relevant authorities.
The Services may link to or rely on third‑party sites, apps, wallets, payment processors, age‑verification providers, or hosting. We do not control and are not responsible for third‑party content, policies, or practices.
The Services and AI Output are provided “AS IS” and “AS AVAILABLE.” To the maximum extent permitted by law, we disclaim all warranties (express, implied, statutory), including merchantability, fitness for a particular purpose, non‑infringement, accuracy, and availability. We do not warrant that the Services or AI Output will be error‑free, uninterrupted, or suitable for any purpose, or that issues will be corrected.
To the maximum extent permitted by law, we and our affiliates, licensors, and providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, revenues, savings, data, or goodwill; or service substitution costs, arising from or related to the Services or these Terms, even if advised of the possibility. Our aggregate liability for all claims shall not exceed the amounts you paid for the Services in the three (3) months preceding the event giving rise to liability. Mandatory consumer rights are not excluded.
You agree to defend, indemnify, and hold harmless us and our affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, costs, and fees (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Services or AI Output; (b) your content, Input, or conduct; (c) your breach of these Terms or Policies; or (d) your violation of law or third‑party rights.
You may stop using the Services at any time (cancellation rules above). We may suspend or terminate the Services or your account at any time with or without notice, including for violations, legal requirements, non‑payment, operational risk, or security reasons. Upon termination, licenses granted to you end immediately.
These Terms are governed by the laws of Spain, without regard to conflict‑of‑law rules. Exclusive jurisdiction and venue lie in the courts of Madrid, Spain. If you are an EU consumer, you may benefit from mandatory protections of your country of residence and may bring proceedings in your local courts as required by EU law.
We may modify these Terms or Policies at any time. Changes are effective when posted on the Services (the “Last Updated” date will change). If you continue to use the Services after changes take effect, you accept the revised Terms.
Severability. If any provision is invalid or unenforceable, the remainder remains in effect.
No waiver. Failure to enforce is not a waiver.
Assignment. We may assign or transfer these Terms. You may not assign without our written consent.
Entire agreement. These Terms plus Policies are the entire agreement regarding the Services.
Language. These Terms are in English. Translations (if any) are for convenience only.
